Judge's ruling blows wide open Government's policy on long term care - Burstow

Commenting on the decision of the High Court today, (25th January), in the Grogan case on Continuing Care Paul Burstow MP said:
" This judgement is good news for thousands of elderly people up an down the country who have been forced to pay for care they thought would be free.
"The Judge's ruling blows wide open the Government's policy on long term care for the elderly. It demonstrates that for years successive Governments have by stealth redrawn the boundary between free care and care that is charged.
"The fact that the judge has criticised the Department of Health for issuing flawed guidance means that every Primary Care Trust in the land is likely to have rules on who gets free care that are unlawful.
"The Secretary of State must make an urgent statement to the House of Commons, either confirming that the guidance will be changed to make it lawful, or that the law will be changed. Either way there must be thousands of people who will have grounds for seeking a refund of the care costs they have had to meet."
